Terms of use

By downloading or using the app, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app. You’re not allowed to copy, or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages, or make derivative versions. The app itself, and all the trade marks, copyright, database rights and other intellectual property rights related to it, still belong to NEXADEV Solutions S.R.L.

NEXADEV Solutions S.R.L is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.

The Cafetino app stores and processes personal data that you have provided to us, in order to provide our Service. It’s your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the Cafetino app won’t work properly or at all.

The app does use third party services that declare their own Terms and Conditions.

You should be aware that there are certain things that NEXADEV Solutions S.R.L will not take responsibility for. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider, but NEXADEV Solutions S.R.L cannot take responsibility for the app not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.

If you’re using the app outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third party charges. In using the app, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app.

Along the same lines, NEXADEV Solutions S.R.L cannot always take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, NEXADEV Solutions S.R.L cannot accept responsibility.

With respect to NEXADEV Solutions S.R.L’s responsibility for your use of the app, when you’re using the app, it’s important to bear in mind that although we endeavour to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. NEXADEV Solutions S.R.L accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.

At some point, we may wish to update the app. The app is currently available on Android & iOS – the requirements for both systems(and for any additional systems we decide to extend the availability of the app to) may change, and you’ll need to download the updates if you want to keep using the app. NEXADEV Solutions S.R.L does not promise that it will always update the app so that it is relevant to you and/or works with the Android & iOS version that you have installed on your device. However, you promise to always accept updates to the application when offered to you, We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.

Changes to This Terms & Conditions

We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page. These terms and conditions are effective as of 2021-09-09

How Cafetino works

Cafetino is a platform that connects buyers and sellers by enabling ends users (you) to select and purchase goods/services from participating third party advertisers (Advertisers). You will be required to pay for your goods/services at the time of ordering through Cafetino and are responsible for collecting/redeeming your goods/services at a time and location agreed between you and the advertiser.

Fees and charges

When You use Cafetino we only charge fees of 2 RON per order, if the total is under 20 RON, or 10% of the total order, if the the total is over 20 RON for Bucharest, Romania on all transactions done through Cafetino. No other Charges will be there from our side. MasterCard and Visa cards will be accepted for payment. Once the payment is made, the confirmation notice for the purchase will be sent instantly to the client in the app.

Refund and cancellation

If the customer canceled before the order is accepted by the coffee shop, Cafetino will do full refund to customer and will only charge the customer the Cafetino fees mentioned before the section ‘Fees and charges’.

If the customer canceled the order after it is accepted by the coffee shop,  Cafetino is not responsible for refunding the customer. Once the order is accepted by the coffee shop, the order is considered placed and the customer is commited on paying the services provided by both Cafetino and the coffee shop.

If the coffee shop canceled the order before accepting the order from the customer, Cafetino will full refund the customer and will only charge the coffee shop the cost of order, described before in the section ‘Fees and charges’.

If the coffee shop canceled the order after accepting the order from the customer, Cafetino will full refund the customer and will only charge the coffee shop the cost of order, described before in the section ‘Fees and charges’.

Refund will be done only through the original mode of payment

Responsibility for content

You acknowledge that much of the content provided on Cafetino relates to Advertiser products, services or information (Advertiser Content). Advertiser Content is not endorsed by Us and We do not warrant that Advertiser Content is accurate, reliable, suitable, complete or of a particular quality.

Your use of Advertiser Content will be on the terms and conditions agreed between you and the Advertiser. You must read all terms and conditions and make your own inquiries with the relevant Advertiser directly and, if required, seek independent advice, before relying on Advertiser Content. We do not take ownership of any Advertiser Content, including any goods/services you may choose to purchase, at any time. You are responsible for enforcing any rights you may have.

PUT SIMPLY: Coffee shops are responsible for ensuring their products are correct on Cafetino.

Unauthorised/Mistaken Transactions

If you believe there has been a mistake or unauthorised transaction on your account, please notify us along with details of the transaction at support@cafetino.app and we will investigate it. We will respond to you within five business days. You may also have the right to dispute transactions relating to Cafetino charged to your scheme (e.g. Mastercard or Visa) credit or debit card with your bank. If you have such a transaction, you should contact your bank for more information. Cardholder must retain a copy of transaction records and Merchant policies and rules

Intellectual property

You grant Us and Our related bodies corporate a royalty free licence to use, reproduce, modify, adapt and communicate to the public the content that You provide to Us or We collect from You for the purposes of using Cafetino.


Our commitment to privacy is set out here. We collect, use and disclose personal information on the terms and conditions set out in Our Privacy Policy. This includes using Your personal information to help Us improve Our products and services and getting in touch with You to let You know about goods, services or promotions that may interest you. Neither We nor You will use or disclose personal information, as defined within the Privacy of other parties unless that use or disclosure is necessary to fulfill obligations under this agreement, is otherwise agreed in writing between the parties, or is required by law.

Your use of Cafetino

By using Cafetino you vouch and represent that you:

– are capable of forming legally binding contracts;

– will not provide Your Cafetino log in credentials to any third party;

– will not use Cafetino in a way that breaches these terms of use, any laws or infringes any rights of third parties;

– will not interfere with anyone else’s use of Cafetino, including sending spam; and

– will not copy, scrape or reproduce content from Cafetino including information about third parties without their consent.

In consideration of the circumstances, and where We think it is reasonable to do so, We may suspend or terminate Your access to Cafetino and reserve the right to take any appropriate steps at law to protect Our interests or those of third parties. User is responsible for maintaining the confidentiality of his account.

PUT SIMPLY: Don’t be that annoying person at a house party, otherwise we’ll have to politely ask you to leave (and by politely we mean suspend your account).

Remember, it’s Your responsibility to be there to collect goods ordered through Cafetino at the time and place agreed between you and the Advertiser. Failing to arrive at the collection point doesn’t count as a Refusal, therefore you will not be refunded.

Mobile security

Mobiles devices which do not have the manufacturer’s operating system installed on them, or that have been modified in a manner not authorised by the manufacturer, are untrusted mobile devices.

If you use an untrusted mobile device to access Cafetino or You have installed applications on Your mobile device (other than those available from the manufacturer’s store), We will not be liable to You for any loss suffered.

Our warranties and limitation of liability

Except for any express warranties set out in these terms and any term implied by law (that cannot be excluded) and Your rights under statutory guarantees provided under the consumer protection laws, We provide no warranties or guarantees to You (including in relation to the performance of Cafetino).

Customer using the website who are Minor /under the age of 18 shall not register as a User of the website and shall not transact on or use the website’’

While We use due care and skill in relation to the provision of Cafetino, neither We nor Our related bodies corporate warrant or guarantee that Cafetino will be continuously available, free from errors or omissions or provided to You within a particular time. If We fail to comply with a statutory guarantee (if it applies) or any term of this agreement, then We limit Our liability for that failure (where it is fair and reasonable to do so in respect of a statutory guarantee) to either supplying Cafetino again, free of charge to You or paying You the cost of having Cafetino supplied again.

We are not liable for any loss to the extent that it was caused by You (for example, through Your negligence or breach of contract). You are not liable for any loss to the extent it was caused by Us.

Cardholder must retain a copy of transaction records and Cafetino’s policies and rules.

PUT SIMPLY: We’re not perfect. If something goes wrong we’ll stop playing ping pong and sort it out for you.

Promotional terms and conditions

Our promotional terms and conditions can be found inside the Cafetino app or website:

– We may change these terms
– We may change these terms of use by publishing an updated version on Cafetino and you may get a copy when further accessing Cafetino. Your continued use of Cafetino following any change will indicate Your acceptance of the change. If the change has a detrimental impact on you but is required by law, or is necessary for technical or security reasons and we will try and give you 3 days prior notice of the change.
